The two proprietors of a care home in Sussex, have been fined £16,000 each plus a total of £22,560 in costs having admitted breaching the Health and Safety at Work etc Act 1974.
The proprietors were procecuted following the death of a client, aged 86, who sustained scald injuries after being immersed into a bath which had not been temperature checked by care assistants in November 2005.
An HSE Inspector commented: "This case highlights the serious consequences of not sticking to the guidance set by Health and Safety for residential care homes. There are a number of reasonable measures the care assistants could have taken that would have prevented this tragic incident. These measures are set out in the Health and Safety guidance for residential care homes, which every care home should have access to."
